Selling a Car After Your Husband or a Family Member Dies in the UAE
When the registered owner of a car dies in the UAE, the car becomes part of their estate and cannot be sold, transferred or (in most cases) driven by someone else until the inheritance is settled. The family first obtains a succession (inheritance) certificate from the court, then the RTA transfers the car into the heirs' names, and only then can it be sold. If there is a bank loan, the bank must be settled first, and many UAE car loans carry life insurance that pays it off. Carology can advise on the steps and buys the car once it is in the heir's name, with a firm offer and payment before you leave.
First: what you can and cannot do
A car registered in a deceased person's name is frozen in the same way as their bank accounts. It cannot be sold or transferred, and the registration cannot be renewed, until the court has confirmed who inherits it. Insurance is usually in the owner's name too, so before anyone drives the car, check with the insurer whether cover still applies. In practice most families leave the car parked until the paperwork is done.
The steps, in order
- Death certificate, attested and translated into Arabic if it was issued abroad
- Succession (inheritance) certificate from the court: the Personal Status court for Muslims, or the relevant court or will registry (for example DIFC Wills or the Abu Dhabi civil court) for non-Muslims with a registered will
- If there is a loan, a clearance letter from the bank after it is settled, or after the loan insurance pays it off
- RTA transfer of the car into the heir's or heirs' names, with the certificate, Emirates IDs and the mulkiya
- Outstanding fines and Salik are settled during the transfer
- Once the car is in your name, it can be sold like any other car
Timelines vary from a few weeks to several months depending on the court and whether there is a will. A lawyer or a typing centre near the court can prepare the application, and for a straightforward estate many families manage it themselves.
If there is a loan on the car
Most UAE car loans include credit life insurance, which pays off the balance when the borrower dies. Ask the bank for the policy details and the claim form as soon as you can, because the bank will not release the mortgage on the registration until the loan is cleared. If there is no insurance, the loan is settled from the estate or from the sale of the car, and a dealer can pay the bank directly from the sale price once the transfer to the heirs is complete.
If the heirs are abroad or there are several heirs
- All heirs named in the certificate must agree to the sale; one heir can act for the others with a power of attorney
- An heir outside the UAE can sign a power of attorney at a UAE embassy or consulate, attested for use here
- If the car is transferred into more than one name, every registered owner signs at the RTA, or gives a power of attorney to the one who sells
Selling the car once it is in your name
At this point most families want the simplest possible route, not a listing and strangers calling. When you sell to Carology you deal only with our team, in our Business Bay showroom. You get one firm offer with no hidden deductions, you are paid by bank transfer or cash before you leave, and we complete the RTA transfer. The valuation is free and there is no obligation. Send the details on WhatsApp first and we will tell you what the car is worth, and what, if anything, is still missing from the paperwork, before you go anywhere.
A note on timing
Nobody should feel rushed into selling. The car does not lose much value in the weeks the inheritance takes, and the registration being expired does not stop a sale to a dealer, because we handle the renewal and transfer. Deal with the certificate first; the sale is the easy part.
